The Texas Alcoholic Beverage Code is comprised of statutes created, repealed or amended by the Texas State Legislature. The Code posted on this page includes changes made by the 84th Legislature.
Administrative Rules are adopted by state agencies after the public is provided notice and the opportunity for comment. Section 5.31 of the Alcoholic Beverage Code gives TABC the authority to "prescribe and publish rules necessary to carry out the provisions of this code." Title 16, Part 3 of the Texas Administrative Code is specifically related to the Alcoholic Beverage Commission.
Proposed rule changes and adopted changes to the TABC administrative rules are posted in the Texas Register published on the Secretary of State's website. The rule book on the TABC website is updated as changes are adopted.
