New TABC General Counsel Takes Office

Texas Alcoholic Beverage Commission General Counsel Clark E. Smith began work at the agency today following his selection by commissioners September 1. Smith will report directly to the three-member commission and will serve as the agency's top legal advisor.

Prior to joining TABC, Smith worked in private practice representing clients in administrative proceedings, appellate litigation and public policy matters. He also worked for the Texas Health and Human Services Commission, where he served as a senior deputy to that agency's chief counsel and executive commissioners. While at HHSC, Smith managed an overhaul of the agency's legal services system and rewrote agency administrative processes.

Smith's experience in managing complex legal challenges in a regulatory environment will prove a great value to TABC, according to Chairman Kevin J. Lilly.

"I was very impressed by Clark's experience, especially the years he spent improving the processes and efficiencies at HHSC," Lilly said. "His knowledge of the administrative courts and the state's role in regulating this complex industry will allow us to improve our performance and help us provide better service to all Texans."

As General Counsel, Smith will oversee the agency's Legal Division, which handles administrative cases against TABC license or permit holders. Smith will also work with the Office of the Attorney General on litigation brought against TABC and coordinate the agency's responses to requests submitted under the Public Information Act.

Smith is a graduate of the University of Texas at Austin, where he earned both his bachelor and law degrees.
